A federal judge in Hawaii on Tuesday threw out all the evidence against a man caught with child pornography at Hilo Airport.

The judge ruled that screeners went too far in searching the man's luggage.

In a ruling that could affect the way the Transportation Security Administration screens luggage. The evidence thrown out on Tuesday included video of the suspect having sex with at least three young boys, prosecutors said.

"You have to let that person off because his rights were violated," defense attorney William Harrison said

This scum had a video of himself having sex with three young boys .. how many others?

upon examination of his luggage pictures fell out ...pictures of child porn .... and his rights were violated? Sad

Perhaps this did not belong in the courts. Just give copies of the video tape to the parents of the boys; natural consequences are the best teaching tool.

I agree, Ron. Sometimes we take the "rights" too far. When those rights usurp the rights of others like those of the 3 kids they need the book thrown at them. If no book a bat will do just fine.

Is this judge protecting pedophiles? I bet if they'd found terrorist literature no one would have given a dam about his "rights". Pedophiles are terrorists!

Let me be the unpopular one here. I agree he ought to be hung up on the nearest tree. But I also believe we have a constitution for a reason. One integral part of that constitution is protection against unwarranted searches and seizures. If the police suspected he might have this, there is a process by which he could have been detained while a warrant was secured.

Due process in this case would have been to report to the police what they saw, tell the officer what it was that concerned them, then let the police use the customary procedures for legal search and seizure. None of that happened. It was stupid, and cost a perfectly good prosecution.

One good thing. They now are onto this guy and no doubt will follow up and get other information not related to this illegal search to bring this clown to justice. The law obeying the law does NOT create any undue hardship.

I agree with Labrys3, would rather see govt going too far to protect rights than going too far the other direction! The line between may at times be a bit gray, better to be on the civil rights side of that line than the police state side.
